2. Purpose and scope
These Terms and Conditions of Use (hereinafter, the "Terms") govern access to, browsing of, and use of the website jaastoy.com, as well as the digital intermediation and commercial lead-generation services provided by JAASTOY.
Access to and use of the website confers the status of "user" and implies full and unreserved acceptance of each and every provision included in these Terms, in the version published at the time the user accesses the website. If the user does not agree with all or part of the Terms, they must refrain from using the website and the services offered.
These Terms apply regardless of the device or means through which the website is accessed, and in all languages in which it is available (Spanish, Valencian, Italian and English).
3. Description of the service
JAASTOY is a digital lead-generation platform that acts as an intermediary between, on one side, users who need to hire certain local professional services (hereinafter, "Clients") and, on the other, independent technicians and professionals who provide those services (hereinafter, "Technicians" or "Professionals").
Currently, the services for which JAASTOY facilitates contact between Clients and Technicians include: handyman services (small home repairs), apartment clearance/removal, cleaning of apartments/homes/tourist rentals, and errands and personal assistance ("recados y gestiones"). The list of services and available geographic areas may be expanded or modified at any time, and will always be kept up to date on the website.
JAASTOY provides its services mainly in the province of Valencia (Spain), although a gradual expansion of its scope of operation to other cities and countries is planned.
JAASTOY does not directly provide the professional services advertised on the website. Its activity is limited to digital intermediation consisting of receiving, managing and forwarding Client requests to the Technicians who are available and compatible with the requested service and city, with those Technicians being solely responsible for the actual performance of the contracted service, in their own name and under their exclusive responsibility.
4. Acceptance of the terms and conditions
Use of the website and any of its features (contact form, technician recruitment form, or others that may be implemented) implies express acceptance of these Terms. Users are advised to read these Terms carefully each time they access the website, as they may be amended in accordance with clause 15.
5. Platform users
5.1 Clients
A "Client" is any person who, through the contact form available on the website, requests information or expresses interest in hiring one of the professional services indicated in clause 3. The Client guarantees that the data provided in the contact form is truthful, accurate and up to date, and that they have sufficient legal capacity to request the service. Submitting a contact request through the form does not create any obligation for the Client to hire a service, nor does it guarantee that a Technician will contact them within a specific time frame.
5.2 Technicians and collaborating professionals
A "Technician" is any individual or legal entity who, through the "Work with us" section (/trabaja-con-nosotros) or another enabled channel, registers on the platform to receive leads related to the services they provide. By registering as a Technician, the user declares and guarantees that: a) they are of legal age and have the legal capacity to enter into contracts; b) they carry out their activity legally, duly registered under the applicable regime (self-employed, company or other admitted legal form) and up to date with their tax and Social Security obligations; c) they hold all licenses, permits, insurance and professional authorizations that may be legally required for providing the offered service; d) the data and information provided about their experience, services offered and cities covered are truthful and kept up to date.
JAASTOY may, although it is not obliged to, carry out basic checks on the information provided by Technicians before or after they join the platform. Under no circumstances does such a check imply any guarantee by JAASTOY regarding the quality, qualifications or solvency of the Technician towards Clients. JAASTOY reserves the right to admit, reject, suspend or remove any Technician from the platform, on justified grounds, particularly in the event of breach of these Terms, repeated Client complaints, or indications of professional malpractice.
6. How the service works
JAASTOY's intermediation service works, in general terms, as follows: the Client accesses the website and completes the contact form, providing their name, phone number, email (optional), the service required, city, a message describing their need, how they found out about JAASTOY and, where applicable, their consent to receive commercial communications. JAASTOY receives the request (the "lead") and manages it internally through its contact management systems. JAASTOY identifies and notifies available Technicians whose profile is compatible with the requested service and the city indicated by the Client. One or more notified Technicians may contact the Client directly, in order to assess the request, provide a quote and, where applicable, agree on the provision of the service.
The contractual relationship for the provision of the specific service (conditions, price, payment method, timing, guarantees, etc.) is formalized directly and exclusively between the Client and the Technician, without JAASTOY acting as a contracting party. JAASTOY does not guarantee that a Technician will contact the Client, nor the time frame within which this may happen, nor the availability of Technicians at all times for all services or cities. Likewise, JAASTOY does not guarantee the final price, quality, outcome or any other condition of the service ultimately provided by the Technician.
7. Economic model: commissions, payments, subscriptions and lead packages
For the intermediation activity described, JAASTOY receives from Technicians a commission on services actually provided to Clients resulting from leads supplied by the platform. The specific economic conditions (commission percentage or amount, payment method and timing) are communicated and, where applicable, formalized directly with each Technician prior to joining the platform.
Without prejudice to the above, JAASTOY reserves the right to implement, in the future, other monetization models, including, without limitation: prepaid lead packages; periodic subscription plans for Technicians (indicatively, Free, Basic and Premium), which may include differences in the volume of leads received, assignment priority or other conditions; and online payment systems allowing Clients to pay, in whole or in part, for certain services directly through the website.
The introduction of any of the above models, as well as their specific conditions of price, scope and operation, will be published on the website prior to its entry into force, becoming an integral part of these Terms from the moment of publication. JAASTOY may modify the applicable prices, commissions and economic conditions, giving reasonable advance notice to any Technicians who may be affected.
8. Prohibition of disintermediation
In order to preserve the proper functioning of JAASTOY's business model, Technicians who receive a lead through the platform agree to: a) not request or induce the Client to hire the service outside of JAASTOY in order to avoid paying the corresponding commission; b) pay JAASTOY the corresponding commission for every service actually provided to a Client who was put in contact through the platform, including additional or follow-up services arising from the same lead that are provided within 12 months of receiving the lead, unless otherwise expressly agreed with JAASTOY; c) not use the Client's contact details provided by JAASTOY for purposes other than managing the requested service, nor disclose them to third parties.
Likewise, Clients are requested, as far as possible, to channel any additional request for services included in the platform's catalogue through JAASTOY, in order to ensure the sustainability of the intermediation service they receive.
Failure by a Technician to comply with the above obligations may result in the precautionary suspension or permanent removal of that Technician from the platform, without prejudice to any legal action JAASTOY may take to claim payment of outstanding commissions and, where applicable, compensation for damages caused.
9. User obligations
All users of the website (Clients and Technicians) agree to: a) provide truthful, accurate and up-to-date information in the available forms; b) make lawful, diligent and good-faith use of the website, in accordance with applicable law, morality, public order and these Terms; c) not use the website for fraudulent purposes, nor introduce or spread computer viruses or other harmful elements; d) not carry out, without JAASTOY's express authorization, mass data extraction (scraping), reverse engineering or other conduct that could harm the proper functioning of the website; e) respect the intellectual and industrial property rights of JAASTOY and of third parties.
10. Exclusion and limitation of liability
JAASTOY acts exclusively as an intermediation and commercial contact-generation platform, without intervening in the actual provision of professional services contracted between Clients and Technicians. Consequently, and to the maximum extent permitted by applicable law, JAASTOY shall not be liable for: a) the quality, suitability, legality, timeliness or outcome of the service ultimately provided by the Technician to the Client; b) damages, losses or claims arising from the contractual relationship between the Client and the Technician; c) the truthfulness, accuracy or validity of the data, qualifications or licenses declared by Technicians; d) the actual availability of Technicians for a specific service or city, nor the response time to a contact request; e) interruptions, errors or failures of the website arising from causes beyond its control; f) the content of third-party websites linked from jaastoy.com.
Clients are advised to verify, prior to contracting, the identity, qualifications, licenses and insurance of the Technician they intend to hire, such verification being the Client's sole responsibility. The provisions of this clause are without prejudice to the rights that applicable consumer protection law grants, on a non-waivable basis, to Clients who legally qualify as consumers.
11. Intellectual and industrial property
All content on the jaastoy.com website, including texts, images, design, structure, source code, logos, trademarks, trade names and databases, is owned by JAASTOY or by third parties who have authorized its use, and is protected by Spanish and EU intellectual and industrial property law. Reproduction, distribution, public communication or transformation of such content is prohibited without prior written authorization, except in cases expressly permitted by law.
12. Personal data protection
The processing of personal data provided by users through the website is governed by the provisions of JAASTOY's Privacy Policy, which forms an integral part of these Terms.

14. Website languages

16. Partial invalidity
If any clause of these Terms is declared null, invalid or ineffective, in whole or in part, such nullity shall not affect the remaining clauses, which shall remain in full force and effect.
17. Governing law and jurisdiction
These Terms are governed by Spanish law. Where the user has the legal status of a consumer, the legal jurisdiction applicable to them under current consumer protection law shall apply, and the consumer may in any case bring proceedings before the courts of their own place of residence. For all other cases, in particular relationships with Technicians and other professionals acting within the scope of their business or professional activity, the parties expressly submit to the Courts and Tribunals of the city of Valencia (Spain).
